Model usage rights in the Philippines: a booking checklist
Define model image use before a Philippine campaign shoot. Use this checklist for channels, territory, duration, paid ads, exclusivity and photographer permission.
Model usage rights describe how a brand may use the model's appearance in campaign images or video. Before booking a model in the Philippines, agree the channels, territory, duration, paid advertising and any exclusivity in writing, and separately confirm permission to use the photographer's work.
Start with the people and the scope. Browse models on Idol, then send the same written brief to each person you shortlist. Use the model talent fee guide to separate the shoot from other items in a quote, and the casting-call template when you need an open call.
Write a usage brief before asking for a quote
The checklist below is an editorial aid, not a legal form or a rate card. Its examples are hypothetical campaign choices.
- Channels. Name the placements and accounts, such as the brand website and brand-owned Instagram account.
- Territory. Identify the intended markets, such as a Philippines campaign.
- Duration. Give a start date and end date, such as a named three-month campaign window.
- Paid advertising. Say whether ads are included. For example, paid Meta ads included and billboards excluded.
- Deliverables and edits. Identify the assets and changes you need, such as six selected photos with crop and colour correction.
- Exclusivity. Define the competing category and period, or state that none is requested.
- Renewal. Set the contact and approval process. Request a fresh quote before extending use.
Keep the final scope with the booking confirmation. If a supplier's quote says only "digital usage," ask which of the placements above it covers. A lower quote with a narrower scope is not a like-for-like comparison.
Check model permission and image copyright separately
Under section 178.4 of the Intellectual Property Code, copyright in a commissioned work stays with its creator unless a written stipulation says otherwise. Paying for a commissioned photograph therefore does not by itself settle every copyright permission your campaign needs.
IPOPHL's photography guidance also explains that commissioning a photograph does not automatically give the client its copyright. Ask who can authorize the intended use and keep their written agreement. Do not assume the model can grant rights held by a photographer.
For the model, specify what the release or booking agreement covers rather than relying on the file name "model release." Match it to the campaign brief. The National Privacy Commission's reminder says processing or sharing images containing personal information needs a lawful basis and must follow transparency, legitimate purpose and proportionality. Have the responsible person for your campaign check that the stated purpose matches the actual use.
A practical confirmation message
We plan to use the selected images on [named channels], for [territory], from [start] to [end]. Paid ads are [included or excluded]. Exclusivity is [defined category and dates, or none]. Please confirm the scope, fee and who will authorize the image copyright use before we book.
This is a briefing aid. Have the final agreement reviewed for your circumstances, especially if several agencies or rights holders are involved.
When the campaign changes
Before adding a new channel, extending the campaign or passing files to another business, compare the proposed use with the agreed scope. Ask for any additional permissions and quote before that use begins. Keep one record of the approved assets, parties and dates so the next campaign manager can check them.

Frequently asked questions
What usage details should a brand agree before booking a model?
Write down the channels, territory, start and end dates, paid advertising, permitted edits and any exclusivity. Ask the model and photographer to confirm the scope before the shoot.
Does paying for a shoot automatically transfer the photo copyright?
No. Section 178.4 of the Intellectual Property Code says copyright in a commissioned work remains with its creator unless there is a written stipulation to the contrary. Check your agreement with the photographer.
Does permission from the model also clear the photographer rights?
Treat them as separate checks. The model agreement covers the agreed use of their appearance; the photographer or other rights holder must also authorize the relevant use of the images.
Can a brand turn an organic campaign image into a paid ad?
Check the written scope first. If paid advertising is outside it, ask the relevant parties to agree the additional use and any fee before launching the ad. Record the channels and end date.
Is there one standard model usage fee in the Philippines?
This guide does not establish a standard rate. Ask for a quote against your actual usage brief, with shoot time, usage and any exclusivity identified separately so you can compare like for like.
